Don is a member at McCauley Lyman LLC, a boutique renewable energy firm in Framingham, Massachusetts. Through a strategic affiliation between the firms, Don and other McCauley Lyman members serve Barclay Damon clients across the country as renewable energy counsel.

He handles commercial and energy matters, primarily focusing on representing developers, investors, offtakers, and other parties in all facets of solar project development. He also represents energy clients in project development and financing, sales and acquisitions, power-contract negotiation and restructuring, and renewable energy attribute trading. Don’s practice is based on broad commercial experience handling commercial, finance, construction, bankruptcy, real estate matters, and restructurings.

Representative Experience

  • Served as outside general counsel to a leading solar developer on projects across the United States.
  • Represented development companies in obtaining debt and equity financing.
  • Represented a company in an arbitration proceeding successfully challenging the denial of a Massachusetts SREC qualification for a project.
  • Served on the creditors’ committee in the bankruptcy of a major energy-trading company.
  • Acted as arbitrator and expert witness in energy-contract disputes.
  • Served as a member of the working group that created FERC’s standard interconnection policies.
  • Assisted a British energy company in implementing new electricity-trading arrangements.
  • Led the legal teams in many power-contract restructurings and related project financings that replaced power, fuel, and financing arrangements for qualifying cogeneration and small power-production facilities with new market-based power-supply arrangements.
  • Served as general counsel to an energy-trading company overseeing the creation of a national network of trading contracts in the United States.
  • Served as lead counsel for the Fauji Kabirwala power project in Pakistan.
  • Represented a party developing an energy-based mixed-use redevelopment of a brownfield industrial area in the Midwest.
