The former Financial Reorganization and Bankruptcy Practice Group chair at Harter Secrest & Emery LLP with over 40 years of legal experience, Jack primarily concentrates his practice on providing strategic advice to companies and creditors in turnaround situations. He represents business owners, large and small businesses, health care facilities, official creditors’ committees, secured creditors, institutional lenders, shareholders committees, and fiduciaries in bankruptcy reorganizations, workouts, and commercial litigation matters. Jack is also available as a mediator and arbitrator in commercial matters.

Representative Experience

  • Obtains confirmation of Chapter 11 reorganization plans for both publicly and closely held corporations, such as technology companies, and sponsors and obtains confirmation of creditors’ plans.
  • Successfully reorganized a large hospital in Central New York under Chapter 11 of the Bankruptcy Code in a case believed to be the first in the country where a sizeable hospital had been successfully reorganized without the hospital’s sale or merger. Advised health care organizations regarding financial restructuring.
  • Served as US creditors’ committee counsel in the Laidlaw cross-border cases dealing with $2.5 billion of unsecured debt. Additional committee engagements included the case of a 90-store supermarket chain with unsecured debt in excess of $100 million and the case of a multi-state auto-parts chain in which a major source of unsecured creditor recovery resulted from claims asserted against an affiliate.
  • Developed strategy as the senior bankruptcy attorney on a team that represented 15 secured institutional lenders in the Chapter 11 cases of the Bennett Funding Group, Inc. and certain affiliates in which debtors owed more than $1 billion and reportedly ran the biggest Ponzi scheme in US history until the Madoff case.
  • Represents institutional lenders in contested seizures of business assets and the enforcement of commercial loan transactions.
  • Represents buyers, sellers, and creditors in sales of distressed businesses and nursing homes through Chapter 11 cases, UCC Article 9 sales, and out-of-court transactions.
  • Successfully represented institutional secured creditors, businesses, and health-care facilities in out-of-court workouts and Chapter 11 cases in the Northern, Southern, Eastern, and Western Districts of New York.
  • Defends bankruptcy-preference claims asserted in national and local cases and represents trustees pursuing claims.
