Biography

Alexis has experience handling health care-related disputes; high-stakes, complex contractual disputes; white collar criminal investigations, including tax fraud, wire fraud, and insider trading; regulatory proceedings brought by the SEC, DOJ, and FINRA; and internal investigations following allegations of securities fraud. Alexis has represented a wide range of financial institutions, public corporations, broker dealers, and asset management firms, including a “Big Four” accounting firm, a multimillion-dollar medical device company, a leading theme park and entertainment company, and one of the largest dialysis services providers in the United States.

Experience

Representative Experience

  • Represented a multimillion-dollar medical device company in a complex federal racketeering lawsuit seeking to stop the operation of an international RICO enterprise and conspiracy and recover a $145 million judgement.
  • Conducted an internal investigation for the board of directors of the largest asset management firm in the world prompted by whistleblower allegations by a member of the firm’s legal department.
  • Represented a leading provider of outpatient dialysis services in a high-profile securities class action in the US District Court for the District of Massachusetts alleging that the company failed to disclose a fraudulent scheme to steer dialysis patients away from Medicare and Medicaid plans into more expensive Affordable Care Act plans.
  • Represented the largest private hotel owner and operator in the US in Delaware Chancery Court to enforce a contractual right of first refusal on a $1.2 billion portfolio of real property assets. Subsequently the company when the defendant filed for bankruptcy in the US Bankruptcy Court for the District of Kansas and the Bankruptcy Appellate Panel for the Tenth Circuit, ultimately securing 35 hotels and a $496 million unsecured claim.
  • Represented a special committee of a board of directors of a publicly traded company in connection with DOJ and SEC investigations into the company’s public statements about a Netflix documentary that allegedly misled shareholders as to the company’s performance and ability to meet earnings guidance.
  • Represented the largest broker-dealer in the United States in connection with an internal investigation arising from allegations that certain members of the institutional sales desk had improperly used confidential customer order information to engage in front running.
  • Represented one of the “Big Four” auditors in connection with an investigation by the SEC following allegations that the auditor’s client—a multibillion-dollar technology company—had improperly recognized revenue for its cloud-computing business.
