Electronic Workplace Posters Now Mandatory in New York State

New York Labor Law Section 201 has been amended to require employers to make available electronically any workplace notices that are required to be posted physically. This includes workplace postings required under both federal and state law. The requirement took effect on December 16, 2022.

The law states that these electronic postings may be made through the employer’s website or via email. While the vast majority of businesses have websites or company-wide email, the law does not address circumstances where an employer does not have a website or email addresses for all of its employees.  

Employers must also notify employees that documents required for physical posting are also available electronically.
