Jason Klimek Quoted in WXXI News Article on Gifting Cannabis

Jason Klimek, Cannabis Team co-leader, was quoted in the WXXI News article “Where the T-Shirts Are Pricey—But the Pot Is ‘Free,’” about how HempSol CBD, a Henrietta, New York, CBD store, is giving away complimentary cannabis with the purchase of a $65 T-shirt. HempSol CBD and other companies are taking advantage of a provision in New York State’s cannabis law that allows adults to give each other up to three ounces of cannabis without compensation.

Jason said, “This is one of those kinds of cute arguments that, ‘Oh, we’re gifting it.’ But it clearly violates the spirit of the law.”

While this gray-area practice has taken place in many states that have legalized recreational cannabis, it is a violation of the law. The article states that gifting cannabis in New York State is largely a consequence of the Office of Cannabis Management still not being fully functional and, therefore, no regulations being in place.
