Barclay Damon Continues to Aggressively Grow its IP Team, Adding Accomplished Life Sciences and Patent Litigators

Vogel and Rifai-Bashjawish Join Henschke to Bring Extensive Client Depth,
AMLAW 100 Experience

September 13, 2017"”Barclay Damon continues to expand its noted intellectual property litigation team with the recent additions of Laura A. Vogel, partner, and Hoda Rifai-Bashjawish, associate. They join Marc Henschke, who joined the firm as a partner earlier this year. These appointments demonstrate the firm's strong and ongoing commitment across the life sciences industry, including to pharmaceutical, biotechnology and medical device companies, by hiring leadings attorneys to provide cutting-edge client solutions.

Laura A. Vogel. Laura has represented pharmaceutical and biotechnology clients in more than 20 Abbreviated New Drug Application (ANDA) cases as litigation counsel or co-counsel. In addition to Hatch-Waxman Act disputes, Laura has been advising clients for 15 years on patent prosecution and portfolio development; due diligence investigations; and freedom-to-operate, patentability, infringement, validity, and inequitable conduct opinions, as well as pre-litigation counseling in pharmaceutical matters. Her practice regularly involves Citizen Petition practice and the analysis of regulatory issues, such as patent-based and FDA-granted exclusivities. Laura represents clients before the US Patent Trial and Appeals Board and has served as counsel in multiple inter partes reviews and interference actions. She has prepared and prosecuted US and foreign patent applications in the areas of biotechnology, pharmaceuticals, food sciences, molecular and cellular biology, recombinant DNA technology, therapeutic proteins, diagnostic assays, gene therapy, vaccines, and tissue sealant technology. A noted speaker, Laura recently presented at the 11th Annual Paragraph IV Disputes ACI Conference and the 4th Annual Conference on Women Leaders in Life Sciences Law. Prior to joining Barclay Damon, Laura was counsel at Wolf, Greenfield & Sacks P.C. and was instrumental in building the Hatch-Waxman practice as an associate and partner at Duane Morris LLP, both in Boston. Laura is admitted to practice in New York, Washington, DC and Massachusetts as well as before the Court of Appeals for the Federal Circuit and is registered to practice before the US Patent and Trademark Office. Hoda Rifai-Bashjawish. Hoda represents clients in district courts and the Federal Circuit, and before the Patent Trial and Appeal Board and Trademark Trial and Appeal Board. Hoda's dual technical background in biomechanical engineering and physics gives her a thorough understanding of clients' complex intellectual property in a broad range of technologies. She also has an extensive pro bono practice, which includes representing non-profits and clients in need of access to health care. Prior to law school, Hoda received a Fulbright US Fellowship grant to study bioethics in Damascus, Syria. Marc N. Henschke.  Marc has extensive first-chair experience in jury trials and Markman claim construction hearings and has litigated patent-infringement cases relating to a wide variety of products and technologies, including wireless modules and systems for IOT applications, network switches and routers, computer hardware and software, medical lasers, high-speed data cables, e-commerce applications, business methods, surgical screws, LCD displays, LANs and VLANs, laptop computers, cell phones, digital still cameras, video cameras, PDA devices, and radar detectors. Marc is well versed in strategies for coordinating the interplay between patent litigations and inter partes review proceedings filed with the Patent Trial and Appeal Board. He has also litigated numerous other types of commercial litigation cases in a variety of jurisdictions. Prior to joining Barclay Damon, Marc was a partner at Foley & Lardner LLP in Boston.
