February 14, 2022—Barclay Damon announces Benjamin Zakarin, associate, has joined Barclay Damon’s Commercial Litigation, Torts & Products Liability Defense, and Insurance Coverage & Regulation Practice Areas. His primary office is New York City.
Zakarin represents clients in a range of commercial disputes in state and federal courts. He has represented corporate and individual clients in high-stakes commercial disputes, including allegations of unfair trade practices, fraudulent inducement, Lanham Act violations, and breaches of royalty agreements. He also represents clients in the defense and prosecution of select securities, tort, and fiduciary litigation matters.
Zakarin also advises and represents corporate clients and individuals under government investigation and facing enforcement actions by state and federal authorities, including actions brought by state attorneys general and federal regulators, achieving favorable outcomes by negotiating early resolutions of ongoing investigations.
Before entering private practice, Zakarin was a deputy attorney general in the Civil Securities Fraud Prosecution Section within the Office of the New Jersey Attorney General. In addition to directing numerous investigations and prosecutions for violations of state and federal securities laws, the False Claims Act, and state consumer protection laws, Zakarin closely coordinated numerous investigations in partnership with the Department of Justice and Securities and Exchange Commission (SEC).
Zakarin also has extensive experience in all phases of the regulatory proposal and adoption process, having drafted several securities-related regulations and engaged with stakeholders at every level. His experience both bringing and defending enforcement actions informs Zakarin’s approach to identifying regulators’ central concerns and, where appropriate, engaging with regulators to find practical, business-friendly solutions and mitigate future risks.
