Hennessey and Burch to Present at Program on "Mineral Rights: What Every Mineral Owner and Lessee Needs to Know Now"

Syracuse, New York - November 8, 2013 - Hiscock & Barclay, LLP Partner Yvonne E. Hennessey and Associate David G. Burch Jr. will be presenting at a full-day Continuing Legal Education program December 11 in Binghamton.

The subject of the program is "Mineral Rights: What Every Mineral Owner and Lessee Needs to Know Now." It is put on by the National Business Institute and will be held from 9 a.m. to 4:30 p.m. at Binghamton Doubletree Hotel.

Hennessey will deliver two programs. The first, "Home Rule: What's Happening Now?" will focus on state rules and local land-use codes, issues and trends, recent case law on home rule preemptions, how local bans and moratoria impact mineral rights, and takings litigation.

The second, "Forced Pooling," will look at forced pooling's effects on development and unleased mineral interests, current state law, the state's compulsory integration model and some recent legislative proposals.

Burch will present "Mineral Leases 101," an hour-and-a-half look at provisions of a mineral lease, best practices for contract drafting, bonus payments and royalties, duration and termination, multiple tracts of land, and tips for negotiating and drafting agreements along with mistakes to avoid.

Hennessey, a Partner in Hiscock & Barclay's Albany office, is Co-Leader of the firm's Oil & Gas Team. She represents clients in the oil and gas sector on a broad range of issues involving shale development including legislation, permitting, project siting and other matters. She is the leading contributor to "Energy Matters," Hiscock & Barclay's blog about the energy industry.

Burch, an Associate in Hiscock & Barclay's Syracuse office, has broad experience in project development matters, advising clients on state tax credit programs as well as other development incentives. He also has experience in real estate leasing matters in a variety of situations, including oil and gas, commercial, and retail leases throughout New York State.
