Biography

An experienced state and federal litigation attorney, Gillian primarily concentrates her practice on defending commercial claims. She handles multi-party cases involving negligence, malpractice, errors and omissions, bad-faith claims, real estate disputes, products liability, wrongful-death claims, breach of contracts, and municipal liability. Gillian also represents primary and excess insurers in insurance coverage litigation arising out of construction, advertising injury, and municipal claims and defends businesses, homeowners, and real estate professionals against claims involving director and officer, premises, and professional liability as well as property-transaction disputes. 

Gillian has appeared at trial, mediation, commercial arbitration, and hearings, and she has argued motions before several state and federal courts.

Experience

Representative Experience

  • Serves as counsel to a Canadian product manufacturer, advising on issues ranging from contracts and risk management to providing comprehensive oversight of domestic claims and litigation.
  • Represented an international manufacturer in multi-party wrongful-death products liability cases.
  • Defended a wrongful-death trucking accident involving the death of a minor.
  • Defended wrongful-death and catastrophic loss cases for several municipalities and government agencies in New England and New York.
  • Managed a retrofit project for an international plumbing manufacturer for products sold to commercial customers. Worked with the client to identify the product sold to customers, distributors, and contractors nationwide. Prepared notices and ensured compliance with several jurisdictions.
  • Obtained a first-impression decision in Rhode Island state court involving the willful destruction of evidence in a wrongful-death trucking case where the court barred the use of any expert witness for the cross-claim plaintiff due to spoliation (Berrios v. Jevic Transportation, Inc., PC-04-2390, 2003 WL 300889 (R.I. Super, Jan. 18, 2013).
