Jason Klimek Quoted in Cannabis Insider Article on CAURD Program Lawsuits

Jason Klimek, Cannabis Team co-leader, was quoted in the Cannabis Insider article “‘Litigation Fatigue’ in NY Cannabis and the Viability of Variscite’s New Lawsuit.” The article discusses New York State’s Conditional Adult-Use Retail Dispensary (CAURD) license program, and specifically, an applicant for the program who has filed multiple suits since 2022. 

The applicant’s lawsuits have focused on the CAURD rules that required applicants to have been convicted of a cannabis crime in New York State and have a “significant presence” in New York State, alleging aspects of New York’s MRTA and state regulations violate the Dormant Commerce Clause.

However, said Jason, “the facts on the ground have changed in such a way that [the] plaintiffs’ claims are no longer accurate” due to the language on a mock application from the Office of Cannabis Management being updated.
