Linda Clark and Brad Gallagher on Rutledge Victory for Independent Pharmacies

Linda Clark, Health Care Controversies Team leader, and Brad Gallagher, counsel, with assistance from Jen Cruz, law clerk, wrote a blog post called “Supreme Court Delivers Victory for Pharmacies and Patients” for the Pharmacy Insider. Linda and Brad note:

Independent pharmacies [are] rejoicing over this year’s holiday gift from the US Supreme Court in providing its long-awaited decision in Rutledge v. Pharmaceutical Care Management Association . . .. In a decision in the making for decades, the Supreme Court unanimously upheld that states are permitted to regulate pharmacy benefit managers. The decision will likely lead to a flood of legislation by states across the nation that will provide for protections for independent pharmacies and their patients alike.
