Rosanna Berardi, immigration counsel at Barclay Damon and managing partner of Berardi Immigration Law, joined Bill O’Reilly on No Spin News to discuss reported questions about how Representative Ilhan Omar, a Democrat from Minnesota, obtained her US citizenship.
Rosanna explained that the key legal question is Representative Omar’s age when she naturalized. Citizenship derived through a parent requires the child to be under 18 and unmarried. If an applicant had already turned 18, they would not have qualified. Rosanna noted that this, not other allegations that have been circulated publicly, is the focus of the reported federal investigation.
She also described the legal options available to the government. In her view, the statute of limitations bars criminal charges. However, the government could pursue a civil denaturalization case if it has clear and convincing evidence that the citizenship application was inaccurate.
