NY Daily Record: Supreme Court Decision May Change Landscape for Website Accessibility Litigation Under the Americans With Disabilities Act

Rob Thorpe, partner, and Martine Wayne, associate, had their “ADA Accessibility Lawsuit Reaches the Supreme Court” and “ADA Tester Case Dismissed by US Supreme Court” articles published by the NY Daily Record. The articles address whether serial litigants, such as Deborah Laufer, have standing to sue in website accessibility lawsuits under the Americans With Disabilities Act (ADA). 

Laufer, who identifies as a serial “tester” plaintiff, has initiated over 600 lawsuits across 22 states against hotels, motels, and other places of lodging, alleging that their websites and online reservation systems are in violation of the ADA. Lower courts continue to be divided on the issue, but rather than addressing standing, the Supreme Court dismissed the case as moot, which, Rob and Martine write, “carries significant implications for the future landscape of website accessibility litigation under the Americans With Disabilities Act.”
